Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "User") and Stayzilla Technologies ("Company", "we", "us") governing your access to and use of the Stayzilla hostel management platform available at stayzilla.co.in ("Platform").

By creating an account, subscribing to any plan, or using any feature of Stayzilla, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or policies referenced herein. If you do not agree, you must immediately cease use of the Platform.

2. Account Registration

• You must provide accurate, complete, and current information when registering. You are responsible for maintaining the accuracy of this information.
• You must be at least 18 years old and have the legal authority to enter into this agreement.
• You are responsible for all activity that occurs under your account, including actions taken by sub-users (staff, wardens) you create.
• You must maintain the confidentiality of your login credentials. Do not share passwords. If you suspect unauthorized access, notify us immediately at sales@stayzilla.co.in.
• You may not create accounts on behalf of third parties without authorization, or impersonate any hostel, person, or institution.

3. Subscription & Billing

3.1 Plans and Fees

Stayzilla is offered under paid subscription plans as described on our Pricing page. Features vary by plan. All fees are quoted in Indian Rupees (INR) and are exclusive of applicable GST unless stated otherwise.

3.2 Billing Cycle

Subscriptions are billed monthly or annually in advance. The billing cycle begins on the date of plan activation. Recurring charges are applied automatically unless you cancel before the renewal date.

3.3 Late Payment

Unpaid invoices will result in account suspension after 7 days from the due date. Data is preserved for 30 days after suspension. After 30 days, the account and data may be permanently deleted.

3.4 Refunds

Subscription fees are non-refundable except where required by applicable Indian law. If you encounter a technical issue that prevents you from using the Platform as described, contact us within 7 days of the charge for a review.

4. Permitted Use

Stayzilla is licensed for use by hostel and student accommodation operators for the following purposes:

• Managing hostel branches, rooms, and student admissions
• Recording and monitoring student attendance
• Tracking conduct incidents and issuing fines
• Managing inventory, expenses, and vendor records
• Communicating with students and parents through the Platform
• Generating reports for internal operational and accounting purposes

The Platform may be used only for lawful purposes and in accordance with these Terms.

5. Prohibited Activities

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any Indian law or regulation
• Upload or transmit false, misleading, or fraudulent information about students, parents, or incidents
• Attempt to reverse-engineer, decompile, scrape, or extract data from the Platform
• Use automated bots or scripts to access the Platform
• Share your account credentials with unauthorized third parties
• Use the Platform to harass, defame, or harm any student, parent, or staff member
• Upload malicious code, viruses, or any disruptive content
• Circumvent any security, access control, or billing mechanisms
• Sub-license, resell, or redistribute the Platform to third parties without written consent
• Misrepresent student conduct records or falsify disciplinary evidence

Violation of these prohibitions may result in immediate suspension or termination of your account without refund.

6. Data Ownership

You retain full ownership of your operational data entered into Stayzilla — including student profiles, attendance records, financial data, and incident logs.

By using Stayzilla, you grant us a limited, non-exclusive license to process, store, and display your data solely for the purpose of delivering the Platform's features to you.

We do not claim ownership over your data and do not use it for our own commercial benefit beyond what is necessary to operate the Platform.

7. Intellectual Property

The Stayzilla platform — including its software code, design, interface, documentation, trademarks, and branding materials — is the exclusive intellectual property of Stayzilla Technologies.

You may not copy, modify, distribute, or create derivative works based on Stayzilla's IP without prior written consent. All rights not expressly granted in these Terms are reserved by Stayzilla Technologies.

8. Service Availability

We strive to maintain high platform availability and target 99% uptime on an annual basis, excluding scheduled maintenance windows. Planned maintenance is communicated at least 24 hours in advance. We are not liable for downtime caused by third-party infrastructure (hosting providers, internet connectivity) or events beyond our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• Stayzilla is provided on an "as is" basis without warranties of any kind.
• We shall not be liable for any indirect, incidental, special, or consequential damages arising from use or inability to use the Platform.
• Our total liability to you for any claim shall not exceed the amount paid by you to Stayzilla in the 3 months preceding the claim.
• We are not responsible for decisions made by hostel operators based on Platform data, nor for the accuracy of student-submitted information.

10. Termination

10.1 By You

You may cancel your subscription at any time from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. Data export is available until account closure.

10.2 By Us

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or fail to pay outstanding fees. For material violations, termination may be immediate without notice. For billing issues, we provide a 7-day grace period.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of courts located in Varanasi, Uttar Pradesh, India.

We encourage users to contact us first for informal resolution of any dispute before resorting to legal proceedings.
